This article is a sequel to an earlier exploration of the possibility of a shift in the Book of Tobit from the Deuteronomistic theological perspective in the beginning to a more nuanced concept of theodicy in the end. The Semitic versions of Tobit found at Qumran are regarded as the earliest witnesses to the story of Tobit, dating from ca. 100 BCE to the early part of the 1st century CE. They are very fragmentary, but the theme of almsgiving recurs (...) at regular intervals in the narrative. In the beginning the Deuteronomistic theological perspective is expressed in terms of Tobit’s belief that God will reward with prosperity those who give alms to their own kinsmen, but towards the end the ideology appears to shift from the rather self-centred ‘prosperity cult’ orientation to a different motivation for almsgiving. The aim of this article is to test the possibility that the almsgiving references are rhetorical hinges that mark the movement of the narrative into a different ideological viewpoint. The complexity of the manuscript transmission of the story of Tobit in the larger matrix of diachronic cultural and religious trends in the ancient Near East is kept in mind when text-critical problems are encountered. At the beginning of the 20th century, the shorter Greek version of the book of Tobit, GI, which is included in the Catholic Bible, was thought to be the oldest version. It was defined as ‘a lesson on almsgiving and its redeeming powers’. As the discoveries of the Semitic copies of Tobit at Qumran, GI is recognised to be a reworking of the longer version GII, most probably originally written in Aramaic, between 225 and 175 BCE. In all versions of (...) Tobit, the theme of almsgiving is introduced as specifically directed to Jewish kinsmen, but towards the end, is to be directed to all poor, suggesting that it may have been written by a Hellenistic Jew. Although the surface context of the narrative of Tobit is the Jewish tradition of proper observation of mitzvot and sacrifice and eventual reward, the various versions contain varying degrees of ancient Near Eastern wisdom, and an ironic, subversive reflection of hypocritical righteousness. This article questioned why the endings differ markedly in different versions. To try to find answers, a semantic comparison was made between GI and the most complete Aramaic version 4Q196. Contribution: This article considered the implications of source criticism in the reception of the various versions of Tobit. The possibility was examined that the pre-Christian, Aramaic version 4Q196Tobit does not confirm the excessive focus on almsgiving as righteousness apparent in the GI version of LXX Tobit. (shrink)

Before the Semitic fragments of 4QTobit were found at Qumran, the 4th-century Greek GI version of Tobit was thought to be original and was regarded as ‘a lesson on almsgiving and its redeeming powers’. In his presentation of the 4Q196–4Q199 (Aramaic) and 4Q200 (Hebrew) fragments of Tobit, Fitzmyer, in 1995, reconstructed and rendered the Semitic lexeme צדקה (literally, ‘righteousness’) as ‘almsgiving’, as in Mishnaic Hebrew. He referred mainly to the 4th-century Common Era Greek and Old Latin versions. The hypothesis of (...) this article is that the Aramaic lexeme צדק may not yet have had the meaning of ‘almsgiving’ in the original composition; thus, the original authorial intention may be masked in Fitzmyer’s presentation. Therefore, the emphasis on almsgiving for ultimate personal gain found in the later copies of Tobit may be a secondary, reductionist application by subsequent scribes of the lexeme צדקה. To test this hypothesis, the relevant reconstructions and English translations as ‘almsgiving’ of the Semitic copies of Tobit found at Qumran are examined and reconsidered. In the beginning of the narrative, in 4Q196 (and in GI and GII) the rather self-righteous Tobit is ‘accidentally’ blinded while performing an act of charity to his own kin, which he believed was the way to gain righteousness and thus be rewarded by God. In the end, when he has recovered his sight, Tobit redefines the way to achieve true righteousness: to bless God and extol his majesty to all nations with truthfulness in heart and soul.Contribution: The comparison of the Semitic fragments from Qumran with the Septuagint versions suggests that the first reconstructions and translations of 4QTobit may have been overly influenced by the long-standing Greek versions. Whereas the Greek versions tend to emphasise almsgiving as a means to gain righteousness, the older Aramaic versions tend to highlight righteousness and truthfulness as the primary value. (shrink)

While there may be a place in some contexts for high handed, “blanket” legislative prohibitions on dissenting views of what constitutes death, the paper under consideration does not describe such a contextThis stimulating and provocative paper by Professor Appel, Defining death: when physicians and families differ, asks us to consider “whether patients’ families should be permitted to opt out of widely accepted definitions of death in favour of their own standards”. This is a striking question in many ways. It reminds (...) us that, as a simple description of fact, there are indeed different standards for human death in so far as different groups or communities have accepted and continue to accept varying notions of what constitutes human death. The question’s reference to “opting out” suggests, perhaps reasonably, that it seems prima facie odd to think of adopting a definition of death as being a matter of individual choice. The reference to “permission” invites us to suppose limitations, primarily legal, upon the extent to which such a choice could be tolerated. Also, the question ascribes to certain “definitions of death” the authority of being widely accepted. The definitions thus favoured are, we learn, the various formulations of death referring to the state of the brain, chief among them “whole brain death” although the author is troublingly vague over whether all such formulations are morally, legally, or conceptually equivalent; and the relevant communities of acceptance turn out to consist of many—but, as the author admits, not all—physicians labouring under varying and inconsistent jurisdictions in the United States.My preface to the criticisms that follow is a …. We describe the growth of interest in the ethics of research with human participants based on articles abstracted in Psychological Abstracts and PsycLZT. Interest was low and variable until 1974, after which there was a marked increase in the number of articles published. We explain this emergence of ethical interest in terms of the social climate of concern for human rights in the 1960s and 1970s, the 1973 revision of the American Psychological Association's ethical principles, and the development of federal (...) regulation of research with human participants. The notion of patients’ duties has received periodic scholarly attention but remains overwhelmed by attention to the duties of healthcare professionals. In a previous paper the author argued that patients in publicly funded healthcare systems have a duty to participate in clinical research, arising from their debt to previous patients. Here the author proposes a greatly extended range of patients’ duties grounding their moral force distinctively in the interests of contemporary and future patients, since medical treatment offered to one patient (...) is always liable to be an opportunity cost in terms of medical treatment needed by other patients. This generates both negative and positive duties. Ten duties—enjoining obligations ranging from participation in healthcare schemes to promoting one’s own earliest recovery from illness—are proposed. The characteristics of these duties, including their basis, moral force, extent and enforceability, are considered. They are tested against a range of objections—principled, societal, epistemological and practical—and found to survive. Finally, the paper suggests that these duties could be thought to reinforce a regrettably adversarial characteristic, shared with rights-based approaches, and that a preferable alternative might be sought through the notion of a “virtuous patient” contributing to a problem-solving partnership with the clinician. However, in defining and giving content to that partnership, there is a clear role for most, if not all, of the proposed duties; their value thus extends beyond the adversarial context in which they might first be thought to arise. Anthropologists have long explained social behaviour as if people always do what they think is best. But what if most of these explanations only work because they are premised upon ignoring what philosophers call 'akrasia' - that is, the possibility that people might act against their better judgment? The contributors to this volume turn an ethnographic lens upon situations in which people seem to act out of line with what they judge, desire and intend. In this essay I suggest that the bioethics profession’s jurisdiction over healthcare ethics consultation is in need of reinforcement. I argue that as the profession becomes more successful, competitors will challenge the profession to justify its ethical claims and ask whose ethics the profession represents. This challenge will come more quickly as the profession tries to influence the ethics of healthcare organizations. I propose a method of bolstering jurisdiction that will make the profession less vulnerable to challenge in the future.

The Gardner report, recently published in the UK, showing a correlation between incidence of childhood leukaemia and paternal exposure to ionising radiations (amongst fathers working in nuclear power plants) has added a new element to debates about both the risk factors in nuclear power plants and the relationships between ionising radiations and leukaemogenesis. The epidemiologic and genetic evidence concerning leukaemias is reviewed here and it is concluded that the leukaemogenic agent, whose existence is indicated in the Gardner report, is unlikely (...) to be paternal radiation dose per se but rather exposure to another factor that is correlated with paternal radiation dose received. I respond to commentaries by Daniel Callahan and William J. Winslade on my article, “Defending the Jurisdiction of the Clinical Ethicist,” all of which are in this issue of JCE.

Patients participating in the shared benefits of publicly funded health care enjoy the benefits of treatments tested on previous patients. Future patients similarly depend on treatments tested on present patients. Since properly designed research assumes that the treatments being studied are—so far as is known at the outset—equivalent in therapeutic value, no one is clinically disadvantaged merely by taking part in research, provided the research involves administering active treatments to all participants. This paper argues that, because no other practical or (...) moral considerations count decisively against so doing, we could and should oblige patients to agree to receive indicated treatment within the terms of any concurrent research protocols. This ensures their treatment will benefit not only themselves but also future patients through contributing to new knowledge. By analogy with the paying of income tax, patients should not be allowed to “veto” their social responsibility to take part in clinical research. (shrink)

The versatile construct of perfectionism has been heavily debated, e.g., its nature or measurement constituents, how it influences performances or, most importantly, our health. Conventional linear analyses seem inadequate to address such challenges. Hence, we used a latent variable and a person-centered approach to identify different patterns of perfectionism, and their relationships with psychological health as outcome among early adolescents (13-14 years) attending conventional or elite sports-/performance-oriented lower secondary schools (14 schools, 832 students, 53% girls). All students completed two perfectionism (...) scales, i.e., the Child-Adolescent Perfectionism Scale (CAPS) and the Frost Multidimensional Perfectionism Scale (FMPS). The criterion-related variables of psychological health included anxiety, depression, eating disorder problems, self-worth and resilience, respectively. Exploratory and confirmatory factor analyses yielded a four-factor representation of perfectionism. Using latent class analysis extracted five profiles of perfectionism, which were related to the criterion variables. Three profiles were clear indicators of either low or high perfectionism score patterns. Two profiles showed a mixed picture of high and low scores, whereas one represented a psychological healthy subgroup. About four of ten adolescents in the ordinary schools matched the two most debilitating perfectionism profiles compared to two of ten in the elite schools. How these results align with international findings is discussed along with the relevance for early interventions aimed at preventing the potential downsides of perfectionism. Longitudinal studies are needed to explore profile trajectories as well as possible health consequences. (shrink)

For most theologians, theology should ultimately be used by the laity and/or the public. However, the religion and science debate has not focused on the divide between theologians and the laity. In this case study I examine the debate among theologians about human enhancement. I focus on the extent to which the structure of the debate in a “mediating organization” between the theologians and the public coincides with the structure of the debate among the theologians. I conduct a survey of (...) participants in the organization, and find that the basic divides among the theologians are largely replicated. These results, when combined with studies of the theologians themselves and the laity, provide a more holistic understanding of the future debate about human enhancement. (shrink)

Is it possible to distinguish, as sociologist Arthur Frank proposes, an ‘ideal of wonder’ within which ill persons could recover some of their former sense of life and flourishing, even within the constraints of ill-health? Beyond this, are there more general benefits in terms of health and well-being that could accrue from cultivating an openness to wonder? In this paper I will first outline and defend a notion of wonder that gives philosophical support to Frank’s proposal, noting why thinking about (...) medical treatment may readily provoke a sense of wonder. Second I will however limit the normative force of such an ‘ideal of wonder’ noting its demands and some of the challenges facing it. The paper goes on, third, to conjecture wider benefits within and beyond the clinical encounter arising from being mindful of the wonder of embodied human agency. Fourth the paper will consider alignments between the foregoing analysis and some theoretical commitments in recent work in health geography. Finally I will briefly reconsider the notion of the body-as-territory, and the role of the imagination in bringing it under wonder’s gaze. (shrink)

Many participants in bioethical debate believe the long-standing myth about the religiously oriented members of the public—that they disagree with scientific fact claims about the natural world. While there are a few conflicts over such claims for a few religious traditions, largely concerning human origins, these fact claims are not relevant for bioethics. Instead, social science research has shown widespread moral conflict between scientists and the actively religious in the United States. The prevalence of moral conflict and the absence of (...) fact conflict is illustrated by the Covid pandemic, where religious objections to vaccines were moral, not factual, in nature. It is important to accurately represent conflicts so that the public sees bioethical input to policy debates as legitimate. (shrink)

Using a fictional but representative general practice consultation, involving the diagnosis of irritable bowel syndrome in a patient who is anxious for some relief from the discomfort his condition entails, this paper argues that when both a drug fails to out-perform placebo and the condition in question is a functional illness with no demonstrable underlying pathology, then the action of the drug is not only no better than placebo, and it is also no different from it either. The paper also (...) argues that, in the circumstances of the consultation described, it is striking that current governance deems it ethical for a practitioner to prescribe either a drug or a placebo, both of which appear to rely for their effectiveness on a measure of concealment on the part of the doctor, yet deems it unethical for a practitioner openly to prescribe a harmless and enjoyable substance which is likely to be no less effective than either drug or placebo and is also likely to be better-tolerated and cheaper than the drug. In the UK, many fundamentally important policy decisions that are likely to affect the relationship between citizens and care services are now made at the sublegislative level and without adequate ethical consideration and scrutiny. This is well exemplified in the proposed guidance on the disclosure of information on children. A recent consultation paper by the UK government on the subject proposes an approach that seeks a simple technical solution to a complex problem, emphasising control and surveillance. This reflects pressure to (...) be seen to act. The document fails with regard to ethical reflection appropriate to the complexity of the issue, an appreciation of complex relationships of trust, and a proper sense of the richness and complexity of the public interest. Such policies would, if implemented, fundamentally change the relationships between citizens and their carers, and among carers and the law and the state. This and similar proposals require far more ethical scrutiny and consideration of the public interest in the widest sense. (shrink)

Bioethicists’ attraction to principlism is rooted in a Western view of how matters that affect the public ought to be deliberated and decided: their resolution ought to be so structured and constrained that it can be understood and verified even by those at a remove from the circumstances of the problem. That view of deliberation, itself fostered by the Western view of government, has encouraged principlism to spread from its source in human subjects research into other areas of bioethics discourse.

Personal life events of a chief executive officer can generate tensions between the CEO’s right to personal privacy and the desire of shareholders for information. Such circumstances can create information asymmetry between the executive management and the shareholders of a firm, a situation likely to produce unfavorable pressures on an organization’s stock price. Failure to fully disclose material personal life events can impact the decision-making actions of the CEO, causing the stock price of the firm to vacillate as a result (...) of rumors and other informational uncertainties. These vacillations in stock price may impact a firm’s liquidity, increase the cost of capital, and affect long term returns to shareholders. We draw upon the ethical leadership and signaling theory literatures to demonstrate how a firm can reduce stock price volatility through a CEO making non-required disclosures that reduce information asymmetry.
